I am not sure Holder needed a waiver to represent the new terrorist captured, even though his firm represented captured terrorist at Gitmo. It looks like he doesn't need a waiver to represent new terrorist based on his ruling on The Christmas Bomber or to move terrorist represented by his previous firm to civil court.
